Henry A Giroux on neoliberalism

We’re living in a time of extremes: extreme weather conditions, extreme political polarization, and extreme power and income inequality. As TruthOut asks, “How did we get to this point? It certainly didn’t happen overnight. Rather, over the course of the last 30 years, the erosion of social contract the New Deal ushered in has reached a stage such that the United States of America is no longer a democratic republic – or a polity concerned with a shared future.

“Henry A. Giroux, a professor of English and Cultural Studies at McMaster University in Hamilton, Ontario, Canada has written extensively on the way in which the political economy has been reconfigured from one that guaranteed citizens a social safety net and promoted paths to a middle class way of life, to a system where a neoliberal oligarchy has accumulated a preponderance of wealth and power that makes democracy impossible, while simultaneously pushing politicians to chloroform the New Deal and Great Society era reforms. The result of this long march to change the fundamental agreement citizens had with their government is a middle and lower class that are compliant, afraid, desperate, and powerless in society- or dispoable. In other words, neoliberal ideologues have squashed democratic movements that use political processes to create a more just and more economically equitable society. The truth about violence and mental health

After mass shootings, like the ones these past weeks in Las Vegas, Seattle and Santa Barbara, the national conversation often focuses on imgres-2mental illness. But as TruthOut asks, ” what do we actually know about the connections between mental illness, mass shootings and gun violence overall?

“To separate the facts from the media hype, we talked to Dr. Jeffrey Swanson, a professor in psychiatry and behavioral sciences at the Duke University School of Medicine, and one of the leading researchers on mental health and violence. Swanson talked about the dangers of passing laws in the wake of tragedy ― and which new violence-prevention strategies might actually work.

“Here is a condensed version of our conversation, edited for length and clarity.Mass shootings are relatively rare events that account for only a tiny fraction of American gun deaths each year. But when you look specifically at mass shootings ― how big a factor is mental illness?On the face of it, a mass shooting is the product of a disordered mental process. You don’t have to be a psychiatrist: what normal person would go out and shoot a bunch of strangers?But the risk factors for a mass shooting are shared by a lot of people who aren’t going to do it. If you paint the picture of a young, isolated, delusional young man ― that probably describes thousands of other young men.A 2001 study looked specifically at 34 adolescent mass murderers, all male. 70 percent were described as a loner. 61.5 percent had problems with substance abuse. 48 percent had preoccupations with weapons. 43.5 percent had been victims of bullying. Coke vs obesity

“Coca-Cola is taking on obesity,” read the AP coverage of the company’s new commercial this week, “with an online video showing how [much] fun it could be to burn off the 140 calories in a can of its soda.”

As The Atlantic reports,”The scene puts a covey of Californians around a comically oversized bicycle on Santa Monica beach. imagesThey stationery-cycle in montage for 20 to 30 smiling minutes each (depending on each person’s size and vigor), until they’ve burned the requisite number of calories to coax an aluminum can along a whimsical Rube-Goldberg-type trapeze. The can eventually reaches the big payoff, when a giant disembodied hand bestows to the pedaler Coca-Cola.

“Not everyone thought it looked fun. “They’re showing exactly why you wouldn’t want to drink a Coke,” brand consultant Laura Riessaid, presumably not while biking. “Twenty-three minutes on a bike is not fun for most people.” (23 minutes was the average time required for a 140-pound person—though as Adweek noted, the average 20-year-old man weighs 196 pounds, and the average woman of the same age weighs 166 pounds.)

“It’s also uncomfortably evocative of a lab experiment where hamsters run on a wheel until they are delivered a pellet of, say, opium. But others in the foodie world were less skeptical of the marketing move than they were enraged by it. I probably would have been too, if I were still capable of strong emotions. What counts as a “school shooting”?

When students are killed, injured, or put in harm’s way on school grounds, when does it “count” as a school shooting? Not all of the time, according to a number of right-wing commentators — and CNN.images-1

ThinkProgress reports that “In a news report published Thursday, CNN amends its prior reporting that there were 74 school shootings since the Newtown Massacre — a number calculated by gun violence prevention group Everytown for Gun Safety — and concludes that there have instead been just 15.

“CNN determined that 15 of the incidents Everytown included were situations similar to the violence in Oregon — a minor or adult actively shooting inside or near a school,” the article explains. Except for the times when those criteria don’t apply: “Some of the other incidents on Everytown’s list included personal arguments, accidents and alleged gang activities and drug deals,” the article explains, apparently nixing Everytown’s bright line criteria that encompassed all incidents “when a firearm was discharged inside a school building or on school or campus grounds, as documented in publicly reported news accounts” in exchange for its own subjective assessment.

“Among those incidents not included was a brawl that escalated outside a college basketball game at Chicago State University, a shooting at a Mississippi town’s football game that left a 15-year-old dead, and a Georgia college that saw two shootings in two days. As Everytown points out in response to CNN, these discounted shootings led to 25 deaths and 45 injuries. They included familiar scenes of students hiding under desks and running for cover. The true student debt crisis

If you borrowed money from the federal government to finance your education and you’re having an extremely hard time paying it back, I have good news for you. As Slate reports, “President Obama has just signed an executive order that expands eligibility for Pay As You Earn, a newish program that caps the monthly debt payments of eligible borrowers to no more than 10 percent of their monthly income. And if you still have outstanding debt after 20 years, or 10 years if you work in the public sector or for a nonprofit, it will be forgiven, like a youthful transgression.imgres-1

“You crazy kid! Remember when you thought taking on this student loan debt made sense because getting a college education meant that you’d eventually earn enough to pay it off? Oh gosh. Those were the days. Clearly you had been passed the peace pipe once too often.

“Cutting debt payments for cash-strapped borrowers is a nice gesture. In 2008 and 2012, Barack Obama fared well with under-30 voters, and Pay As You Earn will give some of them a nice little boost, just in time for the midterm congressional elections. But there is a much larger problem that the president’s feel-good proposal fails to address, which is the fact that people who take on federal student loan debt aren’t earning enough to pay it back. America’s higher education institutions aren’t offering value for money. And that’s a problem that tinkering with the federal student loan program won’t solve.

“To state the obvious: Borrowers can’t handle their debt payments because of the general weakness of the economy. It would be far easier for borrowers to repay their student loan debt if they weren’t unemployed or underemployed, and it would be easier still if they were employed in jobs that offered robust wage gains over time. Yet the debt crisis also reflects the corruption of mass higher education in America.

California rejects teacher tenure

A California judge ruled Tuesday that teacher tenure laws deprived students of their right to an education under the State Constitution and violated their civil rights. imgresThe decision hands teachers’ unions a major defeat in a landmark case, one that could radically alter how California teachers are hired and fired and prompt challenges to tenure laws in other states.

“Substantial evidence presented makes it clear to this court that the challenged statutes disproportionately affect poor and/or minority students,” Judge Rolf M. Treu of Los Angeles Superior Court wrote in the ruling. “The evidence is compelling. Indeed, it shocks the conscience.”

The decision, which was enthusiastically endorsed by Education Secretary Arne Duncan, brings a close to the first chapter of the case, Vergara v. California, in which a group of student plaintiffs backed by a Silicon Valley millionaire argued that state tenure laws had deprived them of a decent education by leaving bad teachers in place.

Both sides expect the case to generate more like it in cities and states around the country. David Welch, a Silicon Valley technology magnate, spent several million dollars to create the organization that brought the Vergara case to court — Students Matter — and paid for a team of high-profile lawyers, including Theodore J. Boutrous Jr., who helped win a Supreme Court decision striking down California’s same-sex marriage ban. While the next move is still unclear, the group is considering filing lawsuits in New York, Connecticut, Maryland, Oregon, New Mexico, Idaho and Kansas as well as other states with powerful unions where legislatures have defeated attempts to change teacher tenure laws.

Charting disaster

As an antidote to the “grow grow grow” mentality of the elected officials and business leaders pushing charter schools, a recent report by University of Oregon professor and political economist Gordon Lafer outlines what’s wrong with privatization of public schools.

The report, titled Do Poor Kids Deserve Lower-Quality Education than Rich Kids? Evaluating School Privatization Proposals in Milwaukee, focuses on the model of Rocketship, a national charter elementary school organization that hopes to expand its Milwaukee footprint to eight schools by 2018.

City officials have even considered carving out the lowest-performing parts of the city’s schools for charters to operate, similar to the New Orleans “recovery district.” Milwaukee’s Chamber of Commerce and Democratic Mayor Tom Barrett are among the charter chain’s supporters, raising millions to help it grow.

Rocketship’s investors, who are tech industry heavyweights, claim altruistic intentions: they care about the kids! But they’re also profiting from the expansion of charter schools, a market for their own products and services.

Case in point: Netflix CEO Reed Hastings, on the board of Rocketship, is also an investor in a company called Dream Box, which runs software the schools use for math applications. In the public sector this type of self-dealing is often prohibited, because schools should be choosing the service or product with the best track record, not the one that will enrich investors.

So it’s no surprise that businessmen like Hastings find investing in charters much more appealing than paying more taxes to support public schools. Continue reading “Charting disaster”

Risky business

Six years after the financial meltdown there is once again talk about market bubbles. The New York Times asks, “Are stocks succumbing to exuberance? Is real estate? We thought we had exorcised these demons. It is therefore with something close to despair that we ask: What is it about risk taking that so eludes our understanding, and our control?imgres

“Part of the problem is that we tend to view financial risk taking as a purely intellectual activity. But this view is incomplete. Risk is more than an intellectual puzzle — it is a profoundly physical experience, and it involves your body. Risk by its very nature threatens to hurt you, so when confronted by it your body and brain, under the influence of the stress response, unite as a single functioning unit. This occurs in athletes and soldiers, and it occurs as well in traders and people investing from home. The state of your body predicts your appetite for financial risk just as it predicts an athlete’s performance.

“If we understand how a person’s body influences risk taking, we can learn how to better manage risk takers. We can also recognize that mistakes governments have made have contributed to excessive risk taking.

“Consider the most important risk manager of them all — the Federal Reserve. Over the past 20 years, the Fed has pioneered a new technique of influencing Wall Street. Where before the Fed shrouded its activities in secrecy, it now informs the street in as clear terms as possible of what it intends to do with short-term interest rates, and when. Janet L. Yellen, the chairwoman of the Fed, declared this new transparency, called forward guidance, a revolution; Ben S. Bernanke, her predecessor, claimed it reduced uncertainty and calmed the markets. But does it really calm the markets? Or has eliminating uncertainty in policy spread complacency among the financial community and actually helped inflate market bubbles? Pre-natal gender bias

Want to find out your baby’s sex before he or she is born? Then you’re probably either a perfectionist or have conservative views about gender, a new study suggests.images

As reported in Time, “Researchers at Ohio State University asked 182 expectant mothers to take personality tests that assessed their thoughts on gender roles and parenting perfectionism. More laid-back moms who seemed open to new experiences were less likely than perfectionist moms to ask the doctor about whether their babies would be boys or girls. “These results suggest women who choose not to learn their baby’s sex may not worry about having clothes, toys and colors for their child that match traditional gender expectations,” said Letitia Kotila, lead author of the study, which will be published in the journal Personality and Individual Differences.

“Finding out your child’s sex before their born, the researchers suggest, may push them towards a certain gender identity later. “If you know ahead of time that you’re having a girl, are you layering on all the pink and purple in a way that is going to push an extremely feminine ideal on your child?” Sarah Schoppe-Sullivan, another researcher who worked on the study, said. “Degrees of Inequality”

We’re having the wrong conversation about higher education in our country.As reviewed in the New York Times, “So argues Suzanne Mettler in her ­provocative new book, “Degrees of Inequality,” based onthe eight years she spent studying a college system that she argues works well for those born into well-off families but few others. Tuition rates of $50,000 or more at private four-year colleges? The trillion-plus dollars Americans collectively owe on college loans? In ­Mettler’s ­telling, those should be the least of our worries when considering the “caste system” that is now higher education in the United States.images

“The picture Mettler offers of the ­postsecondary-education landscape in the United States is not pretty. Looking past the top stratum of elite colleges that normally dominate discussions of higher education (Mettler herself is a professor of government at Cornell University), she chronicles the deterioration of the country’s once-vaunted state college system, where a majority of students pursuing a postsecondary degree are enrolled. She bemoans the fact that the community ­colleges, which play a central role in educating the “less advantaged,” must beg for money, and she lays into for-profit ­colleges like the University of Phoenix, the largest of the 1,000 or so of these institutions that have sprouted up in recent years.

“For-profit colleges are the true bad guys in this tale. Though their “ardent defender,” the Republican Party, contends that the schools provide “meaningful opportunities for low-income and minority students,” Mettler mounts a persuasive case that something like the opposite is true: These institutions are generally more skilled at getting rich off those living in the lower economic reaches than they are at preparing them for the job market. She has mined congressional reports, newspaper accounts and academic ­studies, piling up example after example of recruiters who’ll say practically anything to enroll a student, any student, in their programs, resulting in graduation rates not even close to those of traditional colleges. Workforce at 36-year low

The percentage of American civilians 16 or older who do not have a job and are not actively seeking one remained at a 36-year high in May, according to the Bureau of Labor Statistics.imgres

In December, April, and now May, the labor force participation rate has been 62.8 percent. That means that 37.2 percent were not participating in the labor force during those months.

Before December, the last time the labor force participation rate sunk as low as 62.8 percent was February 1978, when it was also 62.8 percent. At that time, Jimmy Carter was president.

In April, the number of those not in the labor force hit a record high of 92,018,000. In May, that number declined by 9,000 to 92,009,000. Yet, the participation rate remained the same from April to May at 62.8 percent.

The labor force, according to BLS, is that part of the civilian noninstitutional population that either has a job or has actively sought one in the last four weeks. The civilian noninstitutional population consists of people 16 or older, who are not on active duty in the military or in an institution such as a prison, nursing home, or mental hospital.

In May, according to BLS, the nation’s civilian noninstitutional population, consisting of all people 16 or older who were not in the military or an institution, hit 247,622,000. On valuing teaching

How do you change academic culture? One reason that question gets asked a lot is that it’s so hard to answer. Another reason is that so much of academic culture needs changing.images

How might we create a culture that actually esteems effective teaching? The value of such a thing ought to be clear, if only because it would blunt some of the frequent public criticisms of universities for a too-narrow focus on research. But creating a teaching culture hasn’t proved so easy. It’s not that campuses don’t harbor great teachers—even the most research-intensive universities do. But those professors usually tend their personal classroom gardens on their own. They don’t labor as members of a community—or culture—that rewards their teaching and propagates their best ideas about it.

The challenge of how to make good teaching into a communal value has been the subject of the Teagle Foundation’s academic philanthropy for some years now. Last month the foundation convened a meeting, “Community of Scholars, Community of Teachers,” to showcase the efforts of some of its grantees. Professors and administrators described what they had done to create “teaching-positive” environments in the liberal arts at their institutions.

Every one of the grant programs centered on the teaching of undergraduates by graduate students. That’s not surprising. Graduate students do an enormous amount of that work at most universities, so they’re necessary members of any university’s teaching community. But the programs on display at different institutions employ graduate students differently, and at different levels.

Cornell University is working from the bottom up. The university’s teaching center recruited graduate students (in both the humanities and the sciences) for a new fellowship program that leads to a certificate. Dealing with the narcissist in your life

Love is great, but it’s actually empathy that makes the world go ‘round. According to The Atlantic, “Understanding other peoples’ viewpoints is so essential to human functioning that psychologists sometimes refer to empathy as “social glue, binding people together and creating harmonious relationships.”

“Narcissists tend to lack this ability. Think of the charismatic co-worker who refuses to cover for a colleague who’s been in a car accident. Or the affable friend who nonetheless seems to delight in back-stabbing.

“These types of individuals are what’s known as “sub-clinical” narcissists—the everyday egoists who, though they may not merit psychiatric attention, don’t make very good friends or lovers.images

“If people are in a romantic relationship with a narcissist, they tend to cheat on their partners and their relationships break up sooner and end quite messily,” Erica Hepper, a psychologist at the University of Surrey in the U.K., told me. “They tend to be more deviant academically. They take credit for other peoples’ work.”

“Psychologists have long thought that narcissists were largely incorrigible—that there was nothing we could do to help them be more empathetic. But for a new study in the Personality and Social Psychology Bulletin, Hepper discovered a way to measurably help narcissists feel the pain of others.

“First, she gathered up 282 online volunteers who hailed from various countries but were mostly young and female. They took a 41-question personality quiz designed to assess their levels of subclinical narcissism, checking boxes next to statements like “I like to have authority over other people” or “I will be a success.” They then read a story about a person named Chris who had just gone through a breakup, and then took another quiz to determine how bad they felt for Chris. On “Choosing to be Gay”

In politics, the notion of being gay by one’s own volition is like Voldemort—dangerous even to be uttered.

Writing in The Atlantic, Suzanna Danuta Walters states that  “Biological determinism is the new normal, yoked to tolerance claims much as magic hews to Harry Potter. It was not always this way, but a determinist ethos began to insinuate itself into gay politics in the late 1980s or so. As sociologist Vera Whisman noted as early as 1996, “the claim of ‘no choice’ is to a pro-gay stance as the claim of ‘choice’ is to an anti-gay one: a foundational argument. Anti-gay rhetoric uses the term ‘sexual preference’ to imply choice, while pro-gay rhetoric uses ‘sexual orientation’ to deny it.”

“Television shows are full of characters invoking their biology when confronting their queerness, and Hollywood films depict immutability as unassailable truth in movies that present a “tolerance” thesis. In conversations with friends and family, we certainly hear a lot of “but I always knew something was different,” or “I always felt gay,” or something to that effect. These are, unquestionably, very real feelings for many (although assuredly not all) gay people, and I don’t want to deny the experience of that “inevitability.”

“Believing that one is born gay can also become a handy weapon against the harsh treatment by family and society, and an explanatory tool to combat internal self-loathing and doubt. There is clearly some real comfort for gays—particularly those who have navigated the waters of hatred—to come to land on the supposedly solid shores of biology. Does handwriting matter?

Says the New York Times, “Not very much, according to many educators. The Common Core standards, which have been adopted in most states, call for teaching legible writing, but only in kindergarten and first grade. After that, the emphasis quickly shifts to proficiency on the keyboard.images

“But psychologists and neuroscientists say it is far too soon to declare handwriting a relic of the past. New evidence suggests that the links between handwriting and broader educational development run deep.

“Children not only learn to read more quickly when they first learn to write by hand, but they also remain better able to generate ideas and retain information. In other words, it’s not just what we write that matters — but how.

“When we write, a unique neural circuit is automatically activated,” said Stanislas Dehaene, a psychologist at the Collège de France in Paris. “There is a core recognition of the gesture in the written word, a sort of recognition by mental simulation in your brain.

“Handwriting is being dropped in public schools — that could be bad for young minds. Google’s new hands-free computer is finding its way into operating rooms. Breast cancer survivors find the start of their new lives in a tattoo artist’s work.

Medicare to cover reassignment

imgresA federal board ruled Friday in favor of a 74-year-old veteran seeking to have Medicare cover the costs of her gender reassignment surgery, a landmark decision that recognizes it as a necessary medical procedure.

As time magazine reports, “The decision by the Department of Health and Human Services overturns a longstanding rule preventing the government health insurance program from covering such procedures and opens the doors for other Medicare enrollees to make similar requests. It comes at a time when states are beginning to prohibit insurance companies from including specific exclusions for treatments related to gender transitions. So far, five states—California, Vermont, Oregon, Connecticut and Colorado, as well as Washington, D.C.—have prohibited such exclusions. Organizations like the Oakland, Calif.-based Transgender Law Center are fighting for more states to follow suit.

“Though numbers are far from concrete, studies estimate that that 0.5% of the U.S. population is transgender, meaning that they identify with a gender other than the sex they were assigned at birth. Not all of the country’s estimated 1.5 million transgender citizens desire reassignment surgery, a serious procedure that alters a person’s sexual characteristics. That decision may depend on the desire to have children or physical preference, fear of surgery or having other health conditions that would make such surgery risky, as well as the cost of surgery.

“The National Transgender Discrimination Survey, a 2011 report that is the most comprehensive source for data on transgender-related issues, found that the majority of its 6,500 respondents desired surgery of some kind. Academic freedom vs disclosure

Just last month, Virginia’s high court upheld the University of Virginia’s right not to disclose a professor’s emails about his work on climate change to a conservative organization that requested their release under the Freedom of Information Act.images-1
InsideHigher Ed reports that “Now the university is again being asked to disclose a faculty member’s email correspondence and other personal records — this time by a gay rights advocacy group that says it’s concerned that the work of renowned Constitutional law professor Douglas Laycock is being used to support anti-gay and pro-life legislation.
“Although the two Virginia requests came from different sides of the political aisle, experts say they raise similar issues. Namely, experts say, FOIA requests regarding professors’ preliminary scholarship and personal correspondence walk a fine line between ensuring transparency in public institutions and infringing on academic freedom. The newest case is particularly notable due to Laycock’s eminence in the field and the fact that he is married to U.Va. President Teresa A. Sullivan.
“Earlier this month, the university received a FOIA request from two students, in consultation with GetEQUAL, a lesbian, gay, bisexual and transgender rights advocacy group based in Berkeley, Calif. The request seeks access to emails to and from Laycock’s university account to three conservative political organizations, along with phone records from the professor’s work cell phone from January 2012 to May of this year and expense reports for travel during the same period. The request also seeks access to relevant emails sent to and from the professor’s assistant, and the professor’s employment contract. The request says: “At the heart of this [FOIA] request is a general concern University of Virginia resources may have been used to help finance causes that are perpetuating harm to [LGBT] individuals and the reproductive rights of women across the country, including here on UVA’s campus.” Continue reading “Academic freedom vs disclosure”

Three-strikes and mental illness

Passed in 1994, California’s “three strikes” law is the nation’s harshest sentencing law.As Mother Jones reports, “Designed to imprison for life anyone who commits three violent crimes, the law has inadvertently resulted in the incarceration of a lot relatively harmless people, for a long time and at great public expense. Crimes that have earned people life sentences:imgres-1 Stealing a dollar in loose change from a car, breaking into a soup kitchen to steal food, stealing a jack from the open window of a tow truck, and even stealing two pairs of children’s shoes from Ross Dress for Less. The law is one reason that California’s prison system is dangerously, and unconstitutionally, overcrowded. More than 4,000 people in the prison system are serving life sentences for non-violent crimes.

“In 2012, with corrections costs consuming ever more of the state budget, the voters in the state had had enough, and they approved a reform measure that would spring many of these low-level offenders from a lifetime of costly confinement. By August of last year, more than 1,000 inmates had their life sentences changed and were released; recidivisim rates for this group has also been extremely low. But further progress in the reform effort is being stymied by one thorny problem: Nearly half of the inmates serving time in California prisons suffer from a serious mental illness such as bipolar disorder or schizophrenia. So far, judges have been reluctant to let these folks out of their life sentences.

“A new report from Stanford Law School’s Three Strikes project notes that the number of mentally ill prisoners denied relief from a life sentence is three times larger than those without a brain disease. Whither the dean?

An interesting dilemma lies ahead — where will all the academic administrators come from?images

Historically, most administrators in academic affairs, whether they be department chairs, program directors, deans, or provosts, have come out of the ranks of tenured faculty. However with faculty increasingly being contingent and off the tenure track (70 percent), there has not been much consideration of where administrators within academic affairs will come from.

Clearly very different opportunities  and constraints exist at different institutional types,  but the problem will occur across all institutions of higher education to a greater or lesser degree. Fewer tenure-track faculty at research-focused institutions could mean that those who do have tenure will be expected to continue to focus more on grant and research production over leadership.

Teaching-focused institutions, including liberal arts college and community colleges, may be more reluctant to transition faculty from classroom duty to campus leadership. Regardless of institutional mission, it seems as though little action is taken toward leadership succession planning. There are often reports of difficulty filling positions. It’s not unusual to hear of department chairs or deans being chosen because someone was the only individual willing (and able in terms of being tenured, not necessarily commitment or capability) to take the role rather than best suited for it.

An emphasis on related experience, if tenured, has become more relaxed. It is not unusual to hear of an internal dean moving into a provost role, or a chair moving into a dean role after just a year or two, not because the person is an undeniable choice, but because so few other individuals have the experience needed and an external candidate could not be identified. Marriage equality = religious freedom

A coalition of clergy members is challenging North Carolina’s constitutional ban on gay marriage with an unusual approach: They’re filing a federal lawsuit that contends that the ban violates their First Amendment religious freedom rights.

The clergy members said in the lawsuit filed Monday that they would like to perform same-sex marriage ceremonies in their congregations but can’t because of the “unjust law.”images

The lawsuit is one of dozens that have been filed in the wake of the Supreme Court’s reversal of the Defense of Marriage Act last year. Since then, several states have challenged the legality of their same-sex marriage bans. But this is the first to use the First Amendment protection of freedom of religion as the basis for the challenge.

“North Carolina’s marriage laws are a direct affront to freedom of religion,” said the Rev. J. Bennett Guess, executive minister with the Cleveland-based United Church of Christ, which is a plaintiff in the lawsuit. “We feel that it is important that any person that comes into community life of a United Church of Christ congregation be afforded equal pastoral care and equal opportunity to religious services that clergy provide.”

But in North Carolina, clergy are often faced with a troubling decision — “whether to provide those services or break the law,” Guess said. “That’s something no clergy member should be faced with.”

Along with the United Church of Christ, which has more than 1 million parishioners across the country and over 50,000 in North Carolina, a dozen clergy members and same-sex couples were listed as plaintiffs.
